What is PIP and how does it work?

Florida’s New PIP Law to Go Into Effect January 1, 2008

Governor Crist has signed into law the newly revised Florida No-Fault Insurance coverage (Personal Injury Protection or PIP) that had expired on October 1, 2007.

PIP provides $10,000 worth of medical coverage regardless of who is at fault in the car accident.  The new law, which will go into effect January 1, 2008, restricts medical charges and treatment options.  However, there is a gap between the expiration date of October 1, 2007 and January 1, 2008 when there PIP is no longer required.

Florida auto drivers must comply with the state’s financial responsibility laws and carry with them proof of insurance.  Failure to do may result in the suspension of one’s driver’s license. 

Some specific previsions of the new law include:

  • PIP will continue to cover 80% of medical expenses up to $10,000 but the benefits are limited to services provided by a physician, osteopath, dentist or other authorized healthcare provider.
  • Insurers may limit PIP to 80% of a schedule of maximum charges based on usual and customary charges, or the Medicare or worker’s compensation schedule, depending upon both the service and entity providing the service.
  • The PIP insurer must reserve $5,000 of PIP benefits for payments to physicians providing emergency medical care or inpatient care in a hospital.

 

PIP coverage extends to the one insured, relatives residing in the same household, persons operating the insured vehicle,

Property damage liability insurance remains a mandatory requirement of Florida drivers for any period in which PIP is not in effect.  Proof of such insurance must be in the driver’s immediate possession when driving a vehicle.
