In 2002, reporters at The Boston Globe published a series of articles detailing an epidemic of sexual abuse crimes committed by priests and other authority figures operating out of local Catholic dioceses. These explosive revelations inspired similar investigations around the country, including California. As a result, many lawsuits have been filed against various U.S. dioceses by victims of sexual abuse.
Some of these lawsuits have resulted in substantial monetary judgments and settlements. Victims of clergy sexual abuse continue to come forward. In many cases, the crimes in question occurred decades earlier, when the victim was a minor. Some cases of abuse by priests involve victims who were aged 18+ at the time of the incident(s).
Over 300 priests affiliated with the Archdiocese of Los Angeles have been accused of sexual abuse. Many have been named in lawsuits that have resulted in substantial settlements. In 2007, the Archdiocese of Los Angeles settled 508 abuse cases for a total amount of $660 million—a record payout for this ongoing nationwide scandal. The Los Angeles Times has played an important role in tracking ongoing legal developments in the state.
Only a small number of these accused individuals have been convicted by a court of law for committing criminal sex abuse. In numerous instances, the accused individual is deceased.
California Law on Sexual Abuse
On October 13, 2019, California Governor Gavin Newsom signed into law Assembly Bill 218 (AB 218), which extended the statue of limitations that applies to victims of childhood sexual abuse. The law, which officially took effect on January 1, 2020, allows a victim of priest sexual abuse to file a civil lawsuit provided that one of the two following conditions are met:
- The victim is currently under 40 years of age—in other words, they have 22 years after their 18th birthday to take legal action. (Prior to AB 218, the age limit was 26.)
- The victim has discovered (or reasonably should have discovered) within the last five years that they have suffered a psychological injury as an adult due to childhood sexual assault. (Prior to AB 218, the limit was three years.)
Whichever time limit occurs later is the one that legally applies to a victim of childhood sex assault. For instance, someone over age 40 can file a civil lawsuit if they have become aware within the last five years of a sexual assault that occurred in their childhood. Likewise, a person who first became aware more than five years ago of a childhood sex assault can still file suit if they are under 40 years of age.
Another notable feature of AB 218 is the creation of a “lookback” window that gives victims three years from the date of the law’s implementation to file a civil lawsuit even if they are normally barred by the statute of limitations. This window expires on December 31, 2022.
In addition, AB 218 enables victims of childhood sexual assault to be awarded treble (3x) damages in cases where the defendant(s) willfully covered up evidence of the abuse.
